"Malice" for lawsuits has a legal definition that is much narrower than the entire scope of connotations for the regular use of that word.

People who are reporting about the Eramo-Rolling Stone case should not portray the defendants as if they are evil; it is misleading and damaging for reporters to do that, or to neglect the legal definition of "malice" when writing or talking about the case. 

There is no reason to cause the public to form a permanent perception of Ms. Erdely or of Rolling Stone as being malicious people, who plot to hurt others.
